Confirm what is actually changing

We distinguish a change of descriptive name from a change to the trustee, beneficiaries, property or rights. If more than the label is changing, a different legal process may be required.

Use the deed's amendment power

The trust deed and later amendments must be reviewed to identify the proper document and decision-maker. The change should not be drafted in a way that unintentionally affects the trust's substantive terms.

Frequently asked questions

Does changing the trust name create a new trust?

A properly documented change of name should not itself create a new trust, but the deed and proposed document need to be reviewed to avoid changing substantive rights.

Is a trust name registered with ASIC?

The trust itself is not registered as a company. A corporate trustee and any registered business name are separate and may have their own records.

Do we need a new ABN?

That is an administrative and tax question to confirm with your accountant or the relevant registry. We provide the legal deed and supporting records.
