Settlement involves identifying all assets and liabilities, assessing each party's contributions, considering future needs, and arriving at a just and equitable division. There is a 12-month time limit to apply after divorce is finalised and a 2-year limit after de facto separation.
Not necessarily. If both parties agree on financial and parenting matters, arrangements can be formalised through consent orders without a court appearance. Court proceedings are generally only necessary when parties cannot reach agreement.
A BFA is a legally enforceable contract setting out how assets and finances will be divided on separation. It can be made before a relationship, during it, or after separation. Both parties must receive independent legal advice for it to be binding.
